COARE Ownership of the Marks

"COARE", "Shark Safe", "Certified Shark Safe", and their associated logos are trademarks or registered trademarks (hereinafter collectively and individually “Marks”) of The Center for Oceanic Awareness, Research, and Education, Inc. (hereinafter “COARE”) Other trademarks are property of their respective owners. User acknowledges COARE’s exclusive right, title, and interest in and to the Marks and acknowledges that nothing herein shall be construed to accord the user any rights or interest.

User warrants and represents with respect thereto that (a) it will not at any time challenge COARE’s right, title, or interest in the Marks or the validity the Marks or any registration thereof; (b) it will not do or cause to be done or omit to do anything, the doing, causing, or omitting of which would contest or in any way impair or tend to impair the rights of COARE in the Marks; (c) it will not represent that it has any ownership in or rights with respect to the Marks; and (d) it will not, either during or subsequent to these Terms, adopt, use, or register any certification mark, trademark, service mark, trade name, insignia, or logo that is confusingly similar to or a colorable imitation of the Marks or any of COARE’s other marks.

Use of Names and Logos

The aforementioned Marks may not be used by any organization, entity, or individual for fund-raising or self-beneficial publicity without express written permission. User agrees that it shall not modify, enhance or change the Marks or combine it/them with another mark, or use, adopt or register any marks confusingly similar to the Marks. Furthermore, User agrees that it shall not use the Marks, or any portion thereof, as a domain name, including, without limitation, as a sub-domain name or name of a service or company. No User shall use the Marks: (a) in any manner that is likely to reduce, diminish, or damage the goodwill, value, or reputation associated with the Marks; (b) on or in connection with any products or services other than the Certified Products and promotional materials pertaining to the Certified Products; or (e) in any manner other than expressly permitted by written agreement of COARE.

Shark Safe labels and stickers

Shark Safe stickers and labels may not be printed or manufactured, or caused to be printed or manufactured, by any individual, organization, or entity, other than COARE. The Shark Safe logo may , however, by used by authorized licensees for specific and explicit purposes and applications as permitted by written agreement with COARE.

Media representation

Only persons employed by COARE, or those listed as members of its Board of Directors or Advisory Board may claim to represent the Shark Safe program. All media enquiries should be directed to Christopher Chin, COARE's Executive Director, at media [at] coare.org

Control

COARE shall have absolute determination and control, in its sole discretion, over the design, redesign, modification, change, enhancement, improvement, authorized or unauthorized use, manner and degree of application, manner and extent of registration, maintenance, protection, enforcement, ownership, licensing, use and termination of the Marks, and its process of certifying businesses and products.
